Does it matter whose fault the separation is?

No. Australia has a no-fault divorce system — the reason for the breakdown of your marriage is not relevant to the legal process. What matters is that the marriage has irretrievably broken down.

What happens to our property and superannuation?

Property settlements including superannuation are a separate legal process from divorce. There are strict time limits — 12 months from the date your divorce order takes effect to apply for a property settlement. KGM Legal strongly recommends getting advice early.

What if we have children?
